SMS / Text Message Terms of Service

These SMS/Text Message Terms of Service (“SMS Terms”) govern the marketing text message program (the “Program”) operated by euVita Health, Inc. (“euVita,” “we,” “us,” or “our”). By opting in to receive marketing text messages from euVita, you agree to these SMS Terms.
1. Program Description
By providing your mobile number and opting in, you consent to receive recurring marketing and promotional text messages from euVita Health, Inc. Messages may include promotions, special offers, health and wellness updates, service information, product or service announcements, form-completion reminders, and other communications regarding euVita’s products and services.
This Program covers marketing and promotional messages only. Transactional and healthcare-related communications, including appointment reminders, prescription notifications, care-related communications, billing notices, and legally required notices, are sent separately and are governed by your separate consents and applicable law.
2. Sender
Messages will be sent by or on behalf of euVita Health, Inc. from a number to be assigned upon carrier registration.
3. Consent; Electronic Signature
By opting in, whether by checking an opt-in box on a euVita form, texting an opt-in keyword to our number, or completing another approved opt-in method, you provide your prior express written consent to receive recurring marketing and promotional text messages from euVita Health, Inc. at the mobile number you provided, including messages sent using an automatic telephone dialing system, automated technology, or similar messaging technology, even if your number is listed on a federal or state Do Not Call registry.
You agree that your opt-in action constitutes your electronic signature under the federal E-SIGN Act and applicable state electronic signature laws, and that you intend to sign and be bound by this consent electronically.
Consent is not a condition of purchase, treatment, payment, enrollment, eligibility, or receiving healthcare services from euVita Health, Inc., euVita Medical Group PLLC, or any affiliated medical provider.
4. Message Frequency
Message frequency varies based on your activity, preferences, and applicable campaigns. You may receive up to thirty (30) marketing messages per month.
5. Message and Data Rates
Message and data rates may apply. Charges are determined by your mobile carrier and your mobile plan.
6. How to Opt Out
You may opt out of receiving marketing text messages from euVita at any time by replying STOP to any marketing text message. Replies of STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, and other messages that reasonably communicate a request to stop receiving messages, will also be honored as opt-out requests.
After you opt out, you may receive one final message confirming that you have been unsubscribed. If the scope of your request is unclear, we may send you a single message asking you to clarify whether your opt-out applies to marketing messages only or to other categories of messages as well; if you do not respond, we will treat your request as applying to all message categories for which your consent was required.
You may also revoke your consent through any other reasonable method, including by contacting euVita at the email address, phone number, or mailing address listed below. We will honor all revocation requests within ten (10) business days of receipt, or any shorter period required by applicable law.
Opting out of marketing text messages does not automatically stop transactional or healthcare-related communications that are sent under a separate consent or as permitted by law; however, you may separately revoke consent to those communications at any time, and we will honor that revocation as required by applicable law.
To re-enroll after opting out, you may text START to the same number or provide a new valid opt-in through an approved euVita form or authorized method.

8. Supported Carriers
SMS/text messaging is available through most major U.S. mobile carriers. Carrier participation may vary. Mobile carriers are not liable for delayed, blocked, or undelivered messages.
9. Privacy
euVita may collect and maintain your mobile number, opt-in consent, consent source, the disclosure language displayed at the time of opt-in, message history, opt-out status, and related compliance records to operate the Program, manage communication preferences, and document compliance.
We do not sell your mobile telephone number or SMS opt-in consent, and we do not share your mobile telephone number or SMS opt-in consent with unaffiliated third parties for those third parties’ own independent marketing purposes. We may share this information with euVita Medical Group PLLC, other entities operating under the euVita brand, and service providers that assist with CRM, messaging, compliance, hosting, customer support, or analytics, solely for euVita’s own business, operational, healthcare, administrative, or compliance purposes.

10. User Representation
By opting in, you represent that you are the account holder or customary user of the mobile number provided and that you are authorized to provide consent for that number. If your mobile number changes or is reassigned, you agree to notify euVita promptly.
11. Dispute Resolution; Arbitration; Class Action Waiver
A. Informal Resolution First
Before initiating any arbitration or other proceeding, you and euVita each agree to first attempt to resolve any dispute informally. The party raising the dispute must send a written notice describing the dispute and the relief sought to the other party (for euVita, at the mailing address or email address listed below). The parties will then have sixty (60) days to attempt in good faith to resolve the dispute before either party may commence arbitration.
B. Binding Individual Arbitration
Except as provided below, any dispute, claim, or controversy arising out of or relating to these SMS Terms or your participation in the Program shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. Arbitration fees and costs will be allocated as provided in the AAA Consumer Arbitration Rules. The arbitration shall be conducted in Palm Beach County, Florida, by videoconference, or in another location required by the AAA Consumer Arbitration Rules or applicable law.
C. Small Claims Exception
Either party may bring an individual claim in small claims court in a court of competent jurisdiction, rather than in arbitration, if the claim qualifies for that court.
D. Class Action Waiver
You and euVita agree that any arbitration or permitted court proceeding will be conducted only on an individual basis and not as a class, consolidated, collective, private attorney general, or representative action. This provision does not prevent you from bringing issues to the attention of federal, state, or local agencies, and such agencies may, if the law allows, seek relief against us on your behalf.
E. 30-Day Right to Opt Out of Arbitration
You may opt out of this arbitration agreement by sending written notice of your decision to euVita Health, Inc., 515 N Flagler Dr, Ste 350, West Palm Beach, FL 33401, or to support@euvitahealth.com, within thirty (30) days of first agreeing to these SMS Terms. Your notice must include your name, mobile number, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration will not affect your participation in the Program or any other provision of these SMS Terms.
12. Governing Law
These SMS Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles, except where federal law or the mandatory law of another state applies.
13. Changes to These Terms
euVita may modify these SMS Terms from time to time. If we make material changes, we will provide notice by SMS, by posting the updated SMS Terms on our website with an updated effective date, or by another reasonable method, before the changes take effect. Continued participation in the Program after the effective date of revised SMS Terms constitutes acceptance of the revised terms.
